Terms of Service

These Terms of Service govern your access to and use of the Atomic Pay cryptocurrency payment service (the “Service”). Please read these Terms before using the Service.

Last updated: August 1, 2026.

01Acceptance of Terms

By creating an account or using the Service, you confirm that you have read, understood, and accepted these Terms of Service and the Atomic Pay Privacy Policy.

If you do not agree to these Terms, you must not create an account or use the Service.

02About the Service

The Service provides technical infrastructure for accepting and processing cryptocurrency payments.

The Service does not provide cryptocurrency exchange or conversion services. Automatic conversion of cryptocurrency into fiat currency or another cryptocurrency is not available.

The features and capabilities of the Service may change, be expanded, or become temporarily unavailable for technical or operational reasons.

03Account Creation

Only a login and password are required to create an account.

Documents, KYC, and additional checks are not required to use the Service. The user is solely responsible for ensuring that the use of the Service complies with the laws applicable to the user’s business and activities.

The user must:

  • keep their login and password confidential
  • not provide account access to third parties
  • take reasonable measures to protect their account
  • promptly notify the Service of suspected unauthorized access

The user is responsible for the security of their account and the funds displayed in the account’s internal balance.

The Service takes reasonable measures to protect the Service but does not guarantee absolute protection of accounts and internal balances against all possible threats.

Users are advised not to keep funds in the internal balance that are not required for their current operations and to withdraw available funds to an external cryptocurrency wallet in a timely manner.

The user is responsible for all activity carried out through their account and other access credentials.

04Role of the Service and Merchant Responsibility

The Service provides technical infrastructure for processing cryptocurrency payments between buyers and merchants.

The Service is not the seller, supplier, or provider of the goods or services offered by a merchant to its customers. The Service does not participate in setting the terms of transactions between buyers and merchants and is not responsible for the content, performance, or outcome of such transactions.

The merchant is solely responsible for:

  • the description and quality of goods or services
  • the price of goods or services
  • order processing and fulfillment
  • delivery of goods
  • meeting applicable deadlines
  • refunds and order cancellations
  • handling customer claims
  • resolving disputes with customers

All matters related to goods or services, including refunds, must be resolved directly between the merchant and the buyer.

The Service is responsible for the technical processing of cryptocurrency payments within the available features.

05Payment Processing

The Service processes payments in supported cryptocurrencies and networks.

Received funds are credited to the internal balance after the conditions required to confirm the relevant transaction have been met.

The crediting time depends on the selected cryptocurrency, network, and number of confirmations required for the relevant transaction.

Payments below the minimum amount set for a specific cryptocurrency and network will not be credited automatically.

The user is solely responsible for checking the payment amount, cryptocurrency, network, address, and other payment details.

Blockchain transactions may be irreversible after being sent to the network. The Service cannot cancel or modify a transaction after it has been sent to the blockchain.

06Internal Balance and Withdrawals

Received payments are reflected in the user’s internal balance and may be withdrawn to the specified cryptocurrency address.

The user is solely responsible for withdrawing funds to an external cryptocurrency wallet in a timely manner. Users are advised not to keep funds in the internal balance that are not required for their current operations.

Automatic payouts are not supported. Each withdrawal is initiated separately by the user.

Before confirming a withdrawal, the user must check:

  • the recipient address
  • the cryptocurrency
  • the blockchain network
  • the withdrawal amount

After a transaction has been sent to the blockchain, the destination address cannot be changed and the transaction cannot be cancelled unless this is technically supported by the relevant network.

If the user provides an incorrect address or selects an unsupported network, the Service does not guarantee the recovery of funds.

Minimum deposit and withdrawal amounts may differ between cryptocurrencies and networks. The current information is displayed in the Service interface.

07Fees

The fee for accepting payments is 1% of the transaction amount and is fixed.

The user may select the fee payer in the project settings. If the sender pays the fee, it is added to the payment amount.

No Service fee is charged for withdrawals. The user pays only the fee of the relevant blockchain network.

The network fee may depend on the selected network and its current conditions. Blockchain network fees are not controlled by the Service.

08Refunds and Incorrect Payments

The Service does not decide whether funds should be refunded to buyers and is not responsible for refunds relating to transactions between merchants and buyers.

Refunds are handled by the merchant directly and in accordance with the terms of the transaction between the merchant and the buyer.

All refund-related matters must be resolved directly between the merchant and the buyer. The Service does not guarantee that a blockchain transaction can be cancelled or refunded after it has been sent to the network.

The technical possibility of a refund depends on the cryptocurrency, selected network, and status of the original transaction. Any blockchain network fee related to a refund is charged separately.

The Service does not guarantee the automatic processing of:

  • payments made after the applicable payment period has ended
  • payments for an amount different from the specified amount
  • duplicate payments
  • payments sent through an unsupported network
  • payments made in an unsupported cryptocurrency
  • payments containing incorrect details

Such transactions may require additional processing by the merchant or Service support.

09Prohibited Use

The user agrees to use the Service only for lawful purposes and in compliance with applicable laws and regulations.

The Service must not be used for:

  • material containing child pornography
  • distribution of material involving the sexual exploitation of children
  • organizing, promoting, or financing violence
  • sanctions evasion

The user is solely responsible for the legality of their activities, goods, services, customers, and transactions conducted through the Service.

10Supported Cryptocurrencies and Networks

The list of supported cryptocurrencies and blockchain networks is displayed in the Service interface.

The user must use the current payment details and supported network shown in the Service interface.

Support for individual cryptocurrencies and networks may be changed or discontinued for technical or operational reasons.

Changes in the operation of a blockchain network, including protocol updates, reorganizations, chain splits, or discontinuation of the network, may affect the detection, confirmation, and crediting of payments.

11Service Availability

The Service aims to maintain stable operation but does not guarantee continuous availability or uninterrupted operation of all features.

The Service may be temporarily unavailable due to:

  • maintenance
  • software updates
  • troubleshooting

  • other circumstances beyond the Service’s control

Such circumstances include, without limitation:

  • blockchain network failures or congestion

  • military actions
  • civil unrest
  • strikes
  • actions of government authorities
  • changes in applicable law
  • other extraordinary circumstances

During such circumstances, the Service may temporarily limit individual features.

The Service makes every reasonable effort to restore operation and return to normal service.

13Access Restrictions and Discontinuation of Use

The Service does not block accounts due to inactivity or a prolonged period without transactions.

The Service does not freeze funds as part of its standard operation. However, individual features may be temporarily unavailable due to technical issues, maintenance, or other circumstances described in these Terms.

The user may request a withdrawal of the available balance in accordance with the technical conditions of the selected cryptocurrency and network.

The Service may temporarily restrict access to individual features when necessary to protect its infrastructure, resolve a technical issue, or enforce these Terms.

If the user violates these Terms, the Service may discontinue access. The user remains responsible for transactions made before access was discontinued.

Account deletion is not available. The user may stop using the Service, disable available payment methods, and contact support.

14Privacy and Data

Personal data is processed in accordance with the Atomic Pay Privacy Policy.

By using the Service, the user confirms that they have reviewed the Privacy Policy.

The user is solely responsible for the data they provide to the Service.

Information about blockchain transactions may be publicly available on the relevant network and is not controlled by the Service.

15Limitation of Liability

The Service does not guarantee:

  • uninterrupted operation
  • the absence of technical errors
  • continuous availability of all cryptocurrencies and networks
  • the absence of payment processing delays
  • the preservation of cryptocurrency value
  • the ability to cancel or reverse blockchain transactions
  • that the Service will meet the user’s specific business requirements

The Service is not responsible for losses arising from:

  • blockchain network delays, congestion, or failures
  • an incorrect address or network provided by the user
  • an incorrect payment amount or cryptocurrency
  • loss of login credentials, passwords, or other access credentials
  • unauthorized account access caused by the user
  • actions of buyers, merchants, or their counterparties
  • cryptocurrency price changes
  • unavailability of external services, wallets, or blockchain infrastructure
  • integration errors
  • unlawful use of the Service by the user
  • indirect, incidental, or consequential losses

The user is solely responsible for assessing the risks associated with cryptocurrencies, blockchain networks, and digital assets.
